Corporate Commercial Real Estate Counselors (“CCREC”)

CCREC’s strategic discussions, applicability reviews, asset submissions, capital mandate submissions, and Strategic Legacy participation frequently involve sensitive organizational, financial, asset-level, and personal information. This Notice describes how CCREC treats that information and the mutual confidentiality expectations that apply once a strategic dialogue begins.
1. Scope
This Notice applies to information shared with CCREC through Site forms, scheduled discussions, email correspondence, or other communication related to a strategic inquiry, asset, capital mandate, philanthropic real estate matter, or Strategic Legacy participation (“Confidential Information”). It supplements, and should be read together with, CCREC’s Privacy Policy and the non-advisory disclaimer presented on CCREC’s intake forms.
2. What CCREC Treats as Confidential
Confidential Information may include, without limitation: asset identity, location, financial performance, ownership structure, or disposition timing; capital mandate parameters, investment criteria, or institutional identity; organizational, philanthropic, or succession-related information shared in connection with Strategic Legacy or Mousphilan discussions; and any other non-public business, financial, or strategic information disclosed to CCREC in the course of a strategic dialogue.
3. How CCREC Handles Confidential Information
CCREC limits internal access to Confidential Information to personnel directly involved in evaluating or responding to the relevant matter. CCREC does not publicly identify, publish, or disclose the identity of a specific asset, organization, capital participant, or individual in connection with a submission without consent, except: where disclosure is required by law, regulation, subpoena, or legal process; where necessary to protect the rights, property, or safety of CCREC or others; or where the disclosing party has authorized disclosure (for example, to facilitate an introduction the party has requested).
CCREC’s review of submitted information is preliminary and educational in nature, consistent with the non-advisory disclaimer presented at the point of submission, until a separate written engagement, mandate, or formal confidentiality agreement is established.
4. Mutual Expectation Regarding CCREC’s Proprietary Framework
In the same way CCREC treats counterparties’ information as confidential, CCREC asks that visitors and participants treat the CCREC Organization Sustainability Model, CCREC Financial Sustainability Model, related terminology, diagrams, and proprietary methodology as confidential and proprietary, as further described in the CCREC Intellectual Framework Notice published on this Site. Engaging in a strategic discussion does not grant any license to reproduce, distribute, or commercially use CCREC’s proprietary framework materials.
5. Formal Confidentiality Agreements
This Notice is a general statement of practice and does not itself constitute a signed, bilateral non-disclosure agreement. Where a matter warrants a more formal mutual non-disclosure agreement — for example, before exchanging detailed financial records, asset due-diligence materials, or capital mandate specifics — CCREC will provide one for execution prior to that exchange. Until a formal agreement is executed, this Notice governs the parties’ general confidentiality expectations.
6. No Guarantee of Outcome
Treatment of information as confidential under this Notice does not imply, and should not be understood to guarantee, any particular valuation, transaction structure, capital match, nonprofit acceptance, tax treatment, or other financial result.
7. Duration
The confidentiality expectations described in this Notice continue to apply after a strategic discussion concludes, regardless of whether a transaction, engagement, or further relationship results.
